1. ACCEPTANCE OF THESE TERMS

These Terms of Use (the “Terms”) govern your access to and use of TalkWendy.com, including any website, application, content, features, functionality, assessments, reports, tools, chatbot features, conversational systems, and related services made available by Tidy Money LLC (collectively, the “Service”).

The Service is owned and operated by Tidy Money LLC, a New Mexico limited liability company, with a business address at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, Bernalillo County, USA (Business ID #: 7711034; D-U-N-S Number: 132683126) (“Tidy Money,” “Company,” “we,” “us,” or “our”).

By accessing, browsing, registering for, interacting with, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our applicable Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

 

2. THE SERVICE

TalkWendy.com is an artificial intelligence-powered technology platform designed to provide conversational tools, assessments, analysis, content, and reports relating to trading psychology, including the identification of behavioral patterns, cognitive biases, strengths, weaknesses, habits, and psychological tendencies associated with decision-making in trading, investing, or financial speculation environments.

The Service is provided solely for informational, educational, self-reflective, and general guidance purposes.

The Service does not constitute, and should not be relied upon as:

  • financial, investment, trading, legal, tax, accounting, medical, psychiatric, psychological, therapeutic, or other professional advice;

  • a clinical, medical, or mental health diagnosis;

  • psychological or psychiatric treatment;

  • a personalized recommendation to buy, sell, hold, or otherwise transact in any asset or investment;

  • a guarantee of improved trading performance or financial outcomes; or

  • a formal professional opinion, evaluation, or assessment issued by a licensed psychologist, physician, therapist, financial advisor, or other regulated professional, unless expressly stated in a separate written agreement.

You understand and agree that any output, profile, assessment, score, recommendation, conclusion, insight, or response generated through the Service is an automated, general-purpose informational output only.

 

3. NO PROFESSIONAL OR FIDUCIARY RELATIONSHIP

Your use of the Service does not create any therapist-patient, psychologist-patient, physician-patient, advisor-client, fiduciary, agency, employment, partnership, joint venture, or similar relationship between you and the Company.

The Company does not provide clinical psychology, psychiatry, psychotherapy, or regulated financial advisory services through the Service unless expressly agreed in writing under a separate contract.

 

4. ELIGIBILITY

By using the Service, you represent and warrant that:

  • you have the legal capacity to enter into these Terms;

  • you are using the Service on your own behalf or, if on behalf of an entity, you have authority to bind that entity to these Terms; and

  • all information you provide to us is truthful, accurate, current, complete, and not misleading.

The Service is not directed to individuals under the age of majority unless expressly authorized by a parent or legal guardian and permitted under applicable law. Unless otherwise stated, the Service is intended for adults only.

 

5. ACCURACY OF INFORMATION PROVIDED BY YOU

The usefulness and relevance of the Service depend significantly on the accuracy, completeness, consistency, and honesty of the information you provide.

Accordingly, you agree that you will:

  • respond truthfully to prompts, questions, forms, and conversational inputs;

  • not submit false, manipulated, incomplete, or misleading information;

  • not intentionally attempt to distort, game, or influence the results;

  • not use a false identity or impersonate any other person or entity; and

  • not submit unlawful, defamatory, abusive, threatening, discriminatory, fraudulent, or otherwise objectionable content.

We are not responsible for any inaccurate, incomplete, irrelevant, or inappropriate outputs or results to the extent they result from inaccurate, incomplete, inconsistent, misleading, or dishonest information submitted by you.

 

6. USE OF ARTIFICIAL INTELLIGENCE AND THIRD-PARTY SERVICES

You acknowledge and agree that the Service may rely, in whole or in part, on third-party providers and infrastructure, including providers of artificial intelligence models, natural language processing systems, APIs, hosting, cloud storage, data analytics, automation, monitoring, and security services.

As a result:

  • your inputs, outputs, and related data may be processed by third-party providers in accordance with their own systems and infrastructure;

  • we do not control all aspects of the operation, training, availability, performance, filtering, continuity, bias profile, or accuracy of third-party AI systems;

  • AI-generated content may be inaccurate, incomplete, outdated, inconsistent, oversimplified, or unsuitable for your particular circumstances; and

  • we do not guarantee that any output will be accurate, complete, reliable, unbiased, error-free, or fit for any particular purpose.

You assume all risk arising from your reliance on AI-generated or AI-assisted content and are solely responsible for independently verifying any information before acting on it.

 

7. NO FINANCIAL ADVICE; NO CLINICAL PSYCHOLOGICAL ADVICE

TalkWendy.com addresses trading psychology from the standpoint of self-awareness, habits, behavior, and decision-making. It is not a substitute for qualified professional judgment.

In particular, the Service does not provide:

  • personalized investment recommendations;

  • trading signals;

  • guarantees of profitability, consistency, emotional regulation, or performance improvement; or

  • clinical diagnosis of anxiety, depression, compulsive disorders, addiction, trauma, ADHD, personality disorders, or any other mental health condition.

If you are experiencing significant emotional distress, severe impulsivity, compulsive trading behavior, addiction, anxiety, depression, or any other potentially serious mental health concern, you should seek assistance from an appropriately qualified healthcare professional.

 

8. USE AT YOUR OWN RISK

You use the Service at your sole risk and discretion.

Any decision you make based on the Service, whether in whole or in part, including any decision relating to trading, investing, leverage, risk management, capital allocation, education, trading pauses, continued trading activity, or seeking outside support, is your sole responsibility.

To the fullest extent permitted by law, the Company shall not be liable for any losses or damages arising out of or related to your use of, or inability to use, the Service, including capital losses, lost profits, lost opportunities, business interruption, reputational harm, emotional distress, or operational errors.

 

9. ACCOUNTS, ACCESS, AND SECURITY

If certain features require an account, you are responsible for:

  • maintaining the confidentiality of your login credentials;

  • restricting access to your devices and account; and

  • promptly notifying us of any suspected or actual unauthorized access, misuse, or security breach.

We reserve the right to suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, for technical, legal, security, compliance, commercial, or abuse-prevention reasons.

 

10. PROHIBITED CONDUCT

You agree not to, and not to permit any third party to:

  • use the Service for any unlawful, fraudulent, or unauthorized purpose;

  • use the Service as a substitute for professional legal, financial, medical, or psychological advice;

  • copy, reproduce, distribute, license, sublicense, sell, resell, rent, lease, transfer, or commercially exploit the Service without our prior written consent;

  • reverse engineer, decompile, scrape, data mine, crawl, or extract data from the Service, or use the Service or its outputs to train competing models or systems;

  • introduce malware, malicious code, or any other harmful technology into the Service;

  • interfere with the operation, integrity, or security of the Service;

  • impersonate another person or entity or misrepresent your affiliation;

  • upload or submit personal data of third parties without proper authorization or lawful basis; or

  • use the Service to make high-impact automated decisions without meaningful human review.

 

11. USER CONTENT

As between you and the Company, you retain ownership of any information, text, prompts, responses, or other content you submit to the Service (“User Content”), subject to the rights you grant below.

You grant the Company a non-exclusive, worldwide, royalty-free, limited license to host, store, reproduce, process, modify, adapt, analyze, transmit, and use your User Content as reasonably necessary to:

  • provide, operate, and maintain the Service;

  • generate assessments, reports, responses, and other outputs;

  • improve, develop, debug, secure, and support the Service;

  • detect, prevent, and investigate fraud, abuse, misuse, and security issues; and

  • comply with legal, regulatory, or contractual obligations.

You represent and warrant that you have all rights, permissions, and lawful authority necessary to provide the User Content and to grant the foregoing license, and that your User Content does not violate any law or infringe any third-party rights.

 

12. PRIVACY AND INTERNATIONAL DATA PROCESSING

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge and agree that, in connection with providing the Service, your data may be collected, stored, transferred, hosted, or otherwise processed in countries other than your country of residence, including by third-party service providers operating in multiple jurisdictions.

You further acknowledge that information submitted through the Service may be processed by third-party AI and infrastructure providers to the extent necessary for operation of the Service.

While we implement reasonable administrative, technical, and organizational safeguards, no system is completely secure. Accordingly, we do not guarantee absolute security or that unauthorized access, data loss, or technical failures will never occur.

 

13. SERVICE AVAILABILITY AND CHANGES

We may, at any time and without liability, modify, update, suspend, discontinue, or restrict all or any portion of the Service, with or without notice.

Without limitation, we may:

  • add, remove, or change features or functionality;

  • modify the methodology, structure, scoring, or presentation of assessments, profiles, or reports;

  • impose usage limits or access restrictions; and

  • suspend access for maintenance, security, legal, compliance, or business reasons.

We do not guarantee that the Service will be available at all times, uninterrupted, error-free, secure, or compatible with every device, browser, or operating system.

 

14. INTELLECTUAL PROPERTY

Except for User Content, the Service and all associated materials, features, content, design elements, software, source and object code, interfaces, prompts, conversational structures, methodologies, reports, graphics, text, branding, trademarks, logos, databases, and other materials are owned by or licensed to the Company and are protected by intellectual property and other applicable laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended purposes.

No rights are granted to you except as expressly stated in these Terms.

 

15. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

THE COMPANY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SATISFACTORY QUALITY, AND QUIET ENJOYMENT.

Without limiting the foregoing, we do not warrant that:

  • the Service will meet your expectations or requirements;

  • any assessment, profile, score, or output will be accurate, complete, or suitable for your circumstances;

  • the Service will identify all relevant biases, risks, or behavioral patterns;

  • the Service will improve your trading performance or decision-making; or

  • the Service will be uninterrupted, error-free, secure, or free from bugs, bias, or AI hallucinations.

 

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TIDY MONEY LLC OR ITS AFFILIATES, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, SUPPLIERS, SERVICE PROVIDERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, SAVINGS, OPPORTUNITIES, GOODWILL, DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE COMPANY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO THE COMPANY FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

Some jurisdictions do not allow certain disclaimers or limitations of liability. In such jurisdictions, some of the foregoing provisions may not apply to you to the extent prohibited by applicable law.

 

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless the Company and its affiliates, licensors, service providers, and each of their respective officers, directors, members, managers, employees, contractors, agents, and representatives from and against any claims, actions, proceedings, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your access to or use of the Service;

  • your violation of these Terms;

  • your User Content;

  • your violation of any applicable law or the rights of any third party; or

  • your misuse of the Service.

 

18. TERMINATION

We may, in our sole discretion and at any time, with or without notice, suspend or terminate your access to the Service, including by disabling accounts, blocking IP addresses, removing content, or refusing further access, for any reason or no reason, to the extent permitted by law.

Upon termination, all rights granted to you under these Terms will immediately cease, except that any provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law.

 

19. INTERNATIONAL USE

The Service may be accessible from jurisdictions outside the United States. We make no representation that the Service is appropriate, lawful, or available for use in every jurisdiction.

You are solely responsible for ensuring that your access to and use of the Service complies with all laws, rules, regulations, and obligations applicable to you.

We do not represent or warrant that the Service complies with jurisdiction-specific requirements relating to psychology, healthcare, AI, consumer protection, data protection, or financial services.

 

20. GOVERNING LAW; BINDING ARBITRATION; CLASS ACTION WAIVER

These Terms and any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be governed by the laws of the State of New Mexico, without regard to its conflict of laws principles.

Binding Arbitration

To the fullest extent permitted by applicable law, you and the Company agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be resolved exclusively through final, binding, and confidential arbitration on an individual basis, and not in court, except that either party may bring a qualifying claim in small claims court where permitted by law.

The arbitration shall be administered by a recognized arbitration provider in the United States, such as the American Arbitration Association (AAA), under the applicable rules then in effect.

You and the Company each waive any right to a trial by jury or to participate in a court proceeding, except as expressly provided above.

Unless required otherwise by applicable law, the arbitration shall be conducted in English.

Class Action Waiver

To the fullest extent permitted by law, you agree that any arbitration or proceeding shall be conducted only on an individual basis and not as part of any class, collective, consolidated, mass, or representative action.

You expressly waive any right to participate in a class action, collective action, representative action, or consolidated proceeding.

The arbitrator shall have no authority to consolidate claims or preside over any class, collective, representative, or mass proceeding.

 

21. CHANGES TO THESE TERMS

We may revise these Terms from time to time in our sole discretion. When we do, we will post the updated version on the website and update the “Last Updated” date above.

Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the updated Terms.

 

22. SEVERABILITY AND WAIVER

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

No waiver by the Company of any provision or breach of these Terms shall be deemed a further or continuing waiver of that provision or any other provision.

 

23. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other policies or legal notices expressly incorporated by reference, constitute the entire agreement between you and the Company regarding the Service and supersede all prior or contemporaneous communications, proposals, understandings, and agreements, whether oral or written, relating to the subject matter hereof.
